Please read these Terms of Service (“Terms”) carefully before using the Holdo mobile application and related services (“Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By creating an account, downloading the app, or otherwise using Holdo, you confirm that you have read, understood, and agree to these Terms and to our Privacy Policy. We may update these Terms from time to time; continued use of the Service after changes constitutes acceptance of the revised Terms.

2. Description of Service

Holdo is a habit-tracking and behavior-change application. We provide tools to help you track habits, set goals, and view progress. The Service is provided “as is.” We do not guarantee availability, accuracy, or fitness for any particular purpose.

3. Eligibility

You must be at least 13 years of age (or the minimum age in your jurisdiction to consent to use of the Service) to use Holdo. By using the Service, you represent that you meet this requirement. If you are under 18, you should have a parent or guardian review these Terms with you.

4. Account and Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to notify us promptly of any unauthorized use. We are not liable for any loss or damage arising from your failure to protect your account.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not use the Service to violate any law, infringe others’ rights, transmit harmful or illegal content, attempt to gain unauthorized access to our or others’ systems, or interfere with the Service’s operation.

6. Not Medical or Professional Advice

Holdo is not a medical, psychological, or professional advice service. The Service is for informational and self-tracking purposes only. It does not diagnose, treat, or prevent any condition. If you have a medical or mental health concern, addiction, or other condition requiring professional care, you should consult a qualified healthcare or other professional. Reliance on the Service for health or life decisions is at your sole risk.

7. Limitation of Liability

To the fullest extent permitted by applicable law, Holdo and its operators, affiliates, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use or inability to use the Service, even if advised of the possibility of such damages. Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us, if any, in the twelve months preceding the claim, or one hundred dollars (USD), whichever is less. Some jurisdictions do not allow certain limitations of liability; in such jurisdictions, our liability will be limited to the maximum extent permitted by law.

8. Indemnification

You agree to indemnify, defend, and hold harmless Holdo and its operators, affiliates, officers, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any third-party rights.

9. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice. You may stop using the Service at any time. Upon termination, your right to use the Service ceases. Sections that by their nature should survive (including Limitation of Liability, Indemnification, and Governing Law) will survive termination.

10. Governing Law and Disputes

These Terms are governed by the laws of the jurisdiction in which Holdo’s operator is established, without regard to conflict of law principles. Any dispute arising from these Terms or the Service shall be resolved in the courts of that jurisdiction, and you consent to personal jurisdiction there.

11. Changes to Terms

We may modify these Terms at any time. We will indicate the “Last updated” date at the top. Material changes may be communicated via the app or by email where appropriate. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
